Terms of Service for Surveillant

surveillant.ai is a service operated by Marketcode Sp. z o.o., a private limited company registered in Poland.

1. Acceptance of Terms

By accessing or using Surveillant ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Surveillant is a SaaS platform that applies AI video analytics to footage from cameras you already operate, providing search and alerting on detected events. Features may be added, changed or removed over time.

3. Accounts

  • You must provide accurate registration details and keep them up to date.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • You must be legally capable of entering into a binding contract to use the Service.

4. Acceptable Use

You agree not to:

  • use the Service in breach of any applicable law or regulation;
  • upload or process content you have no right to process, or that infringes the rights of others;
  • attempt to gain unauthorised access to the Service, other accounts, or related systems;
  • interfere with or disrupt the integrity or performance of the Service;
  • resell or redistribute the Service without our written permission.

5. Subscriptions and Billing

  • Paid plans are billed in advance on a recurring basis (monthly or annually) as shown at checkout.
  • Payments are processed by Stripe. We do not receive or store your full card details.
  • Subscriptions renew automatically until cancelled. You can cancel at any time from your account; cancellation takes effect at the end of the current billing period.
  • Fees may change; we will give notice before a change applies to your next renewal.

6. Your Data

You retain ownership of the content and data you submit to the Service. You grant us the limited right to host, process and transmit that content solely to operate and support the Service for you. Our handling of personal data is described in our Privacy Policy.

7. Intellectual Property

The Service itself, including its software, design and trademarks, remains the property of Marketcode Sp. z o.o., a private limited company registered in Poland and its licensors. These Terms do not transfer any of those rights to you.

8. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate access where these Terms are breached, where required by law, or where continued provision would expose us or other users to material risk.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that automated results it produces will be accurate or complete. You are responsible for reviewing outputs before relying on them.

10. Limitation of Liability

To the maximum extent permitted by law, Marketcode Sp. z o.o., a private limited company registered in Poland is not liable for indirect, incidental, special or consequential damages, or for lost profits or lost data, arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited by law.

11. Changes to the Terms

We may update these Terms. Where changes are material we will give reasonable notice through the Service. Continued use after the changes take effect constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of Poland, without regard to conflict of law principles.
